ARTICLE 1 – DEFINITIONS
For the purposes of these General Terms and Conditions, the following terms shall have the meanings set out below:
Cancellation Period:
The time frame during which a customer may exercise their legal right to cancel a purchase made at a distance.

A natural person acting for purposes that are outside their trade, business, or professional activity, who enters into a distance agreement with Olivia’s Maple Shop.
Ongoing Agreement:

Right of Cancellation:
The statutory right allowing the customer to withdraw from a distance agreement within the applicable cancellation period.
Company:
Olivia’s Maple Shop, the seller of goods or services through remote means.
Distance Agreement:
A contract concluded between Olivia’s Maple Shop and a customer using exclusively remote communication methods (such as online checkout, email, or telephone).
CESOP:
The Central Electronic System of Payment Information established under European Union regulations to monitor certain cross-border payment transactions processed by payment service providers.

ARTICLE 3 – APPLICABILITY
These General Terms and Conditions apply to every offer, order, and distance agreement concluded between Olivia’s Maple Shop and a customer.
Prior to completing a purchase, customers will have access to these Terms electronically. By placing an order, the customer confirms acceptance of these conditions.
ARTICLE 4 – OFFERS AND PRICING
All product listings and promotional offers are non-binding and subject to availability.
Olivia’s Maple Shop reserves the right to revise, withdraw, or modify any offer at its discretion.
Prices displayed on the website are clearly stated and include applicable taxes unless otherwise specified. Shipping costs, customs duties, or additional charges (if applicable) will be disclosed before checkout.
ARTICLE 5 – FORMATION OF AGREEMENT
A purchase agreement is formed once the customer completes the checkout process and receives an order confirmation email from Olivia’s Maple Shop.
We reserve the right to refuse or cancel orders in cases including, but not limited to:

ARTICLE 6 – RIGHT OF CANCELLATION
Customers have the right to cancel their order within 14 days of receiving the product, without providing a reason.

Returned items must be:

Return shipping costs are the responsibility of the customer unless otherwise stated.
ARTICLE 7 – REFUNDS FOLLOWING CANCELLATION
If a cancellation request meets the stated conditions, Olivia’s Maple Shop will issue a refund within 14 days after receiving the returned product.
Refunds will be processed using the original payment method unless otherwise agreed.
Shipping fees are non-refundable unless required by law.
ARTICLE 8 – IMPORT DUTIES, TAXES, AND CUSTOMS
For international orders, the customer is considered the official importer of record.
Customers are fully responsible for:

Olivia’s Maple Shop is not liable for delays, additional charges, or confiscation resulting from customs processes.

In accordance with European Union regulations effective from 2024, certain cross-border payment data may be reported by payment service providers to CESOP for regulatory monitoring.
Where applicable, transaction data may be processed in compliance with these legal obligations. Olivia’s Maple Shop adheres to all relevant financial and data protection regulations.
ARTICLE 10 – PRODUCT COMPLIANCE AND WARRANTY

If a product is defective or incorrect, the customer must notify us in writing within 14 days of receipt.
Products returned under warranty claims must be unused and in their original packaging unless the defect prevents this.

Orders are typically delivered within 30 days, unless a different timeframe is stated at checkout.
If a delay is anticipated, customers will be informed within 14 days of placing the order.
For shipments outside Canada:
The customer acts as the importer of record and is legally responsible for complying with all local import laws and customs requirements.
Delays or issues arising from customs inspections, duties, or regulatory procedures do not entitle the customer to automatic cancellation or refund.
ARTICLE 12 – COMPLAINT HANDLING

Complaints should be filed within 7 days of identifying the issue.
We will respond within 14 days of receiving the complaint. If additional time is required, we will provide an estimated resolution timeline.
ARTICLE 13 – GOVERNING LAW AND DISPUTES
These General Terms and Conditions are governed by the laws applicable in Canada.
In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation.
If no resolution is reached, disputes shall be submitted to the competent court within the appropriate Canadian jurisdiction.
